Jerry Cosby,Divorce Mediator with Texas Mediation Group. Let’s talk about child support. Child support in the state of Texas is money paid for the benefit of the children. The courts and the law consider that money to belong to the kids, and the custodial parent (normally the mother), receives that child support only for the benefit of the children. We see a lot of resentment, a lot of —— on the part of husbands who think that the money is not going, or will not go, where it should. So there are some human elements there that we have to deal with. The courts are adament about that because they consider the kid’s benefit, and the kids, to be a major interest to the courts, the community, and the law. The non-primary custodian, which is normally the husband, is required to pay the insurance cost of the health insurance on the children, in addition to paying child support. The child support amount is typically 25% for one child, 30% for two, 35% for three children, and that’s figuring off the gross income, normally of the husband, less federal income taxes, less social security taxes, and less the amount he’s paying for health insurance for the kids. It does not include deductions for things like 401Ks, insurance on his life, and that sort of thing. The courts like for the money to be paid through the Texas Child Support Administration down in San Antonio, and to be deducted automatically by the employer, and sent through that system.
