According to court records, the terms of the Imprelis class action lawsuit settlement require DuPont to compensate tens of thousands of property owners for their dead and damaged trees, including costs for removal, replacements, maintenance and warranties. The Imprelis class action lawsuit settlement also provides for compensation to herbicide applicators for costs they incurred while investigating plant and tree Imprelis damage. Participants in the settlement may still file claims for environmental or personal injury damage. The U.S. Environmental Protection Agency (EPA) issued a Stop Sale and Removal Order for Imprelis in August 2011, after the agency investigated hundreds of reports of Imprelis tree death throughout the Northeast and Midwest U.S. Imprelis had only been approved for sale in October 2010, but by the time it was pulled from the market, it had killed or damaged thousands of ornamental landscape trees.

According to a report from Bloomberg.com, DuPont has set aside $ 750 million to compensate property owners for Imprelis-damaged trees, and has said costs could reach $ 900 million. However, that figure includes compensation paid through the companys Imprelis claims program, and doesnt include the class action lawsuit.
